Investor-state arbitration: Swiss investor files ICSID claim against Kenya

In December 2025, Travizory Border Security SA, a Swiss-based border security technology company, filed a treaty-based claim against the Republic of Kenya at the International Centre for Settlement of Investment Disputes (ICSID). The dispute relates to a border-crossing management agreement and is purportedly covered by BIT Switzerland - Kenya 2006 and ICSID Convention - Arbitration Rules.

Travizory Border Security SA v. Republic of Kenya (ICSID Case No. ARB/25/54) was officially registered on December 16, 2025. The dispute relates to Kenya’s decision to replace its visa authorization and border management system—originally managed through Travizory’s technology—with a platform developed by a local vendor. The Swiss company is pursuing the claim as a treaty-based investment dispute, alleging that the state’s actions harmed its investments in the country’s border management infrastructure.

The Claimant is represented by Lalive, Geneva, Switzerland while the Respondent, Republic of Kenya, is represented by Office of the Attorney-General and the Department of Justice, Republic of Kenya, Nairobi, Kenya.
