This article is a bit heavy on rhetoric itself. In India, groups have been complaining about cheap imports of synthetic rubber from Sri Lanka / cocunut imports from Sri Lanka etc creating issues for local producers. Same goes in Sri Lanka but the article gives no specifics. Its too much of a superficial critique than citing specific examples.

Just a few questions: imagine that, say, a Canadian investor invests in big infrastructure works (new airport, waste incinerator etc.), in Bulgaria, in competition with a local entrepreneur close to local highest level authorities. Do you think he will be able to operate his investment smoothly? When de facto expropriated , do you think he will be indemnified properly by local judiciairy courts?
If the same investor invests in waste treatment in Sicilia in competition with mafia interests. Are you sure his probable de facto expropriation will be rewarded by all Sicilian judges?
When Sorros made huge investments in top level education in Hungary but had to flee to Berlin, do you think the Hungarian judiciary would compensate him for this de facto expropriation?
Barring for obvious past abuses, do’nt you think that ISDS has merits? Are you sure a careful drafting of the clause as in CETA does not merit consideration?

Alguien me podría aclarar cómo influye esto en una tratado multilateral como es el Tratado de la Carta de la Energía, firmado por la propia Unión Europea y la Comunidad Europea de la Energía atómica?. No soy conocedor de estos temas y por eso me gustaría saber cómo ahora la UE y a través del TJUE puede anular los arbitrios o laudos con soporte en un tratado MULTILATERAL y reafirmado recientemente entre todos los países en Mayo de 2015 (todavía no se han cumplido tres años, se cumplen este próximo domingo). No sé por qué pero me parece que esto tiene más calado de lo que pueda parecer, sobre todo cuando la UE intenta anular laudos arbitrales "a posteriori" en un contexto internacional que ella misma a firmado y ratificado. No tendrían que anular primero los Tratados multilaterales previamente firmados. Es que si no la propia UE tiene una "responsabilidad" inherente en todo lo que está sucediéndo. No sé si es que el CETA además tiene un encaje de "privilegio" por algún oscuro motivo.

Une fois de plus procès d’intention et intox.
1.TOUS les accords commerciaux conclus par l’UE depuis qu’elle existe contiennent une formule de consultation des parties en matière de standards techniques, normes SPS etc. Le CETA n’est pas plus contraignant qu’aucun autre accord commercial à ce sujet. Et pourtant l’UE a les normes les plus protectrices au monde;
2. Tout assouplissement des protections UE doit avoir l’accord des 28/27 Etats membres et du Parlement Européen. Si le glyphosate est démontré (potentiellement) nocif sur base de conclusions scientifiques avérées, jamais l’UE, même aiguillonnée par des multinationales canadiennes ou autres n’obtiendrait les majorités requises
3. Le canada c’est 37 millions de consommateurs. l’UE c’est 111 millions. Croyez pas que c’est plutôt les canadiens qui vont adopter les normes européennes pour avoir accès à un marché trois fois plus grand que le leur?

How can any country even think about investing / dealing with Indonesia. They treat foreign company’s with contempt and will steal there money and assets as soon they can. They revoke mining licences on flimsy grounds with the intention of taking the asset back once it becomes valuable. The while country is un-investable until the corrupt officials are taken to account.

Désolé, mais la conclusion est inverse: la Cour a considéré que la clause d’arbitrage entre les Pays Bas et la Slovaquie était nulle parce qu’elle pouvait conduire des arbitres à interpréter du droit UE sans s’en référer à la Cour. Cet arrêt, en fait, invalide la plupart sinon toutes les clauses d’arbitrage bilatérales prises en dehors du cadre du droit de l’UE. Par contre, cet arrêt confirme que les clauses d’arbitrage prises dans un cadre UE (comme bien entendu le CETA) sont (les seules) valables.

It’s of the utmost importance that Britain gets its act together. Going to Japan, with no more substance than what PM May has shown untill now, opens the door for EU27 to provide Japan with a better offer.
The money threat, being made by some MP’s, can be compensated by accommodation, on the continent, of new manufacturers of all sorts, who are now outside the EU27.
The same goes for the worldclass financial sector. Not having it now, poses a challenge to establish the world’s best financial centre in the EU27 from this day onward. And I see no reason, why the EU27 can’t rival the City of London.
As an European citizen I deplore the choice made in the Referendum. But leaving the EU opens doors for the UK. That’s okay, good luck.
But I don’t understand, that the UK can’t grasp the fact that the same applies to the EU. We are going make the best of our future, also to compensate for the possibility of a big financial gap, caused by the chance of having no deal at all.
Leaving and making a country poorer by choice is a UK decision. We don’t want to be dragged into that, non of the EU27 look forward to get poorer.
If a deal with Japan provides the EU27 with better opportunities, we have to seize that momentum. It would be foolish not to do so.
Everything is on the table and nothing is agreed untill everything is agreed.

Any contract with hidden provisions is eligible to be declared null and void under common law of contract. These phoney trade deals are not consistent with lawful, good faith customary practice. We have to demand that all trade deals conform to putting the public interest as the primary objective. That could be achieved if activist groups are willing to join Goal 16 of the 17 Sustainable Development Goals for 2030 - which seeks to overhaul dysfunctional institutional systems and achieve equal justice for all. #bccic.ca/gecco
