    Je suis professeur de droit international de développement à l’Université de Marrakech. Ancien expert de l’Institut de l’OMC et expert actuel de la CNUCED sur les accords internationaux d’investissements.

    Suite à un Colloque sur les Accords commerciaux régionaux à l’UQAM à Montréal (en octobre 2010) et auquel j’avais participé, je compléte la rédaction d’un article sur le Statut avancé (de 2008) entre l’UE et le Maroc. Cependant, je ne possède pas le texte juridique de l’accord sur le libre-échange agricole signé en décembre 2009. J’aimerais bien l’avoir ?

    Pour ce qui est de l’échec des négociations sur un accord agricole entre la Suisse et l’UE, c’est tout à fait légitime et démocratique si certains responsables de partis politiques suisses ou responsables de la Fédération suisse ont eu une influence sur l’arrêt de ces négociations. Car ils pensent avant tout à l’intérêt général de leurs concitoyenns Suisses. Bref, ce n’est pas véritablement le cas au Maroc ? A preuve, les vrais décideurs politiques et économiques marocains ne défendent pas semble-t-il les intérêts majeurs de leur population ?

    The upper claim that this text has been "signed" is not correct !!!

    EU commission public communication from 20 of Oct 2010 on the currents status of FTA negations with COLOMBIA and PERU reads a follows:

    Negotiations for a multiparty trade agreement (MTA) with Colombia and Peru were successfully concluded at a technical level in February 2010.
    Ecuador provisionally suspended its participation in the negotiations in July 2009 but contacts are maintained to explore the possibility to include Ecuador in the MTA.
    The text of the Agreement negotiated with Colombia and Peru is currently under legal and linguistic review.

    That the agreements have not yet been signed has been reconfirmed by The European Commission during a public meeting in Brussels "Ad hoc meeting - Bilateral Trade Negotiations: State of Play" 26 Oct 2010

    An EU FTA usually will have to be initialed on negotiators level, signed and ratified.

    So there might be a misunderstanding based on difference of legal status between "initialing" on the technical level and "signing" of an agreement.

    Once a treaty has been signed [authenticated], states cannot unilaterally change its provisions. This is the reason why a legal and linguistic review has to take place before signature.

    So while these texts give a clear picture of the final agreement it is not uncommon that during such a review process the fact emerges that the negotiators did unknowingly made commitments or chose formulations of which they did not oversee the full legal implications. Some recent examples for such a situation have been some of so called interim EPAs between the EU and ACP countries.

    It is unclear what will happen if the legal review leads to the conclusion that text might have to be changed and in how far this will lead to de facto re-negotiations.

    Important is that as long as the text has not been signed the text is still formally open for change. After signature this will be much more difficult.

    The transparency provided here by bilaterals.org about what is (or has been) on the table still allows parliaments and civil society to control in how fare their governments fulfilled their given mandate and to demand (if necessary) changes in the text before decision makers are confronted with a "take it or leave it" position.

    p.s. I still grow open-pollinated corn for our few remaining cattle that we have left after our farm was gutted by people claiming to be FOR the family farmer. I think Farmer’s Union may (emphasis: may) still be okay but National Farmer’s Organization definitely is not, nor are ANY of the organic certification and selling agencies. It’s all a LIE, a rip-off under the control of government and bureaucracy. Do not support them!

    Es preocupante lo que esta pasando en estos momentos en el sector lechero, pero hagamonos esta pregunta Si el sector de los grandes productores se esta quejando ante la entrada del TLC con la union europea que puede decirse del pequeño y pobre productor? este es un tema que no puede dejarse ante un vacio bacilante de saber si se importa o se exporta una cantidad X de productos del sector primario. Como competiremos con paises banguardista cuando son ellos los que si estan preparado para dicho tratado?. que va a ser del campesino si seguimos obviando sus necesidades y que pasa con los recursos y con los impuestos tan caros que si estamos pagando los pobres y pequeños productores.? Sera que Colombia y el gobierno estatal beneficiara y dara los subsidios que si se otorgan en otros paises productores?.

    En mi opinión, los acuerdos de equivalencia están violentando nuestro régimen jurídico nacional, al desconocer los mecanismos establecidos en las leyes emanadas del Congreso de la Unión, para la revisión de las normas de que se componen, pues por la vía de la facultad reglamentaria, El Poder Ejecutivo, sin respetar el concurso y competencia del Poder Legislativo, en los hechos está procediendo a incorporar la aplicación de la normatividad extranjera y sus efectos, dentro del territorio nacional.

    Las medidas de integración regional, pudiendo ser plausibles, no pueden “dar la vuelta” a la aplicación del derecho nacional y menos relevarlo de su cumplimiento, para estimular el intercambio comercial, pues favorecer la simple agilización del ingreso de mercaderías extranjeras, con la aceptación del solo cumplimiento de los requisitos considerados por regimenes extranjeros y sin medidas de reciprocidad, pueden poner en riesgo a la industria nacional y en entredicho la soberanía del país.

    La negociación asimétrica en las relaciones internacionales, no pueden servir de pretexto para obtener acuerdos poco claros, cuya negociación tenga puntos cuestionables en materia de legalidad interna, por ello debe exigirse a todas las autoridades de nuestro país, que estén atentos a este tipo de negociaciones, para que desplieguen en toda su amplitud la competencia de que se les ha dotado, para salvaguardar efectivamente los intereses nacionales.

    I agree totally with the aswer given from the anonimous reader. I find it very unlikely that the current Georgian government planned such an extensive operation to catch these people for bribery. Everyone knows the system of operation in Georgia and what the government there is capable of. It is clear from the video show on television that these people were framed with a mafia style operation and not a democratic country operation.

    “Ethical” plan of the Government of “How not to pay for the debt”

    Georgian government needs to release foreign businessmen immediately and pay for own $100 million debt. It’s so clear that government planed it all and invited Israelis in Turkey to set them up. First they thought about the possibility to negotiate $100 million debt with the Israelis. Remember that Georgia had violated the multilateral Energy Charter Treaty and unlawfully expropriated investments made by Israelis! The argument that Georgian Government brings to make their actions sound ethical is that Georgia was corrupted back in 1990. Obviously if the government was corrupted the documents signed back then would not be real. Why Jewish well respectful businessmen have to pay for Georgians mess?
    After the failure to negotiate old debt Georgian Government decides to use their power in order to “deactivate” foreign businessmen. The old fashion KGB way to do it is to set victims up. Government reps tricked Israelis in Georgia and pretended that they were interested in a long time business relationship with them. Georgian officials probably told Israelis that they are ready to receive an offer from them as a bribe. They spent government money to fly in Turkey, rent a hotel room, set up security cameras, invited foreign victims disappointed with the Georgian legislation system in the past and started their “negotiations”.
    After Georgian officials recorded planed session of negotiations with Israelis they were ready to wrap their one year plan and arrested principles of Israeli company. Victims of this “ethical” plan of “How not to pay for the debt” were locked out in jail far from their homes and denied in the right to ask for the return on the investment.
